Lessor – “RENTSCOOTER” , concludes this Agreement (hereinafter the “Agreement”) with the Renter as follows:
1. Subject matter
1.1. Lessor shall provide the vehicle (hereinafter the “Scooter”) to the Renter for the temporary use agreed upon by the Parties. The Lessor will provide the Renter with all documentation necessary for the exploitation including respective accessories and equipment.
1.2. The Renter is obliged to use the Scooter only according to this Agreement and shall pay the price of the lease (hereinafter the “Rent”).
1.3. The Renter shall return the Scooter on the date agreed.
2. Condition of Scooter
2.1. The Lessor states that the above-mentioned Scooter is in good condition and free of any known defects or faults which would affect its safe operation under normal use.
2.2. The Renter declares that it has inspected the Scooter and confirms that the latter has no defects.
3. Warranties
3.1. The Renter states that he / she is physically and legally qualified to operate the above-described Scooter.
3.2. The Renter is not under the age of 18 years.
3.3. The Renter will use the Scooter in person and it will not let any third person to use it.
4. Prohibited use
4.1. The rented Scooter shall not be used to carry commercial passengers or property for hire.
4.2. The rented Scooter shall not be used to carry more than 2 persons.
4.3. The rented Scooter shall not be used for any race or in any competition.
4.4. The rented Scooter shall not be used for any illegal purpose.
4.5. The Renter shall not operate the Scooter in a negligent manner and must follow the operating instructions at all times.
4.6. The Renter (driver) will at all times maintain a ZERO blood Alcohol.
4.7. The Renter is solely responsible for the payment of any and all fines.
4.8. The Lessor assumes no liability for the Scooter in case of delay in pickup and return of the Scooter.
4.9. It is forbidden to leave the territory of the city with a motor vehicle of up to 110 cubic meters (The Renter is responsible for the consequences of the violation.).
4.10. In case of any breach hereof, the Lessor is entitled to seize the Scooter with immediate effect. The fees paid will not be reimbursed.
4.11. In case of delayed return of the Scooter, the Lessor may charge the Renter with a reasonable monetary penalty at its sole discretion.
5. General Terms
5.1. There is no limit on the mileage/kilometers driven.
5.2. In case of any damage, the deposit money will not be returned to the Renter. The Lessor can charge the Renter additional sums in case the deposit is not sufficient to cover the damage.
5.3. The Lessor will terminate this Agreement, if the Renter breaches any of the terms hereof.
5.4. In case of an accident, the Renter shall immediately contact Police on the following number: 112 and also notify the Lessor on the following number: +995 595 85 05 45.
5.5. Relationships, which are not regulated by this Agreement, shall be governed by the current Georgian legislation.
